and one for an ex-wife. >> reporter: halloran texted death threats. mathiesen tried to calm him down. that's when halloran shot him. >> we heard arguing over there. >> reporter: the terrified girlfriend ran out of the house. causing halloran to take the mother hostage. that's when the brother stepped in and grabbed a weapon and shot halloran in the head. >> the brother was very brave, he saw that he had taken his mother hostage and he took a weapon and shot him in the head. >> reporter: the brother is not expected to face any charges. reporting live in petaluma, pati lee. the deputies family and friends are now struggle to cope with what happened.

his niece spoke with us today about her uncle. >> he literally would take his shirt off and give it to you if you needed it. he would do whatever you needed. >> reporter: we are learning much more about deputy mathiesen and the impact he had on friends and loved ones. we will have that story on bay area news at 7:00 on tv 36. a search and rescue effort is under way tonight at yosemite national park. they have received several reports of at least one hiker going over vernal fall. the missed trail going up to vernal fall has been shut down. the trail will be closed until noon tomorrow. in san francisco, police tonight are trying to fig figure out how a body ended up in a u-haul van that was left for days and nobody said anything until now.

rob roth is in the neighborhood and spoke to people in the area. >> reporter: right here on 17th aver people said they just had no idea what was inside if van that was parked right here in front of walgreens. >> reporter: the medical examiner was called to the van, while the cause of death has not yet been determined, authorities do not suspect homicide. >> the u-haul company had sent a tow truck driver to reclaim one of their u-haul trucks. and the driver opened the rear cargo area and found a man he thought was unconscious or dead. >> reporter: people who live, shop or work in the area say it's eerie to know they may have walked by a van not knowing what was inside. some never even noticed it until police came out this afternoon. >> it's kind of scary because this is a really friendly neighborhood. i've grew up here. i live up the street and just like seeing that, so close to home and where you work at is kind of eerie. >> nobody thought it was nothing. just a regular parked car and

it wasn't moved for a while. about a week maybe. >> what do you think now? >> a little uncomfortable actually. someone finding a body. >> reporter: the medical exam they examiner has not released the victim's name. rob roth, ktvu news. a san rafael man was arranged in marin county for allegedly threatening barbara boxer. 47-year-old kevin joseph oconnell did not enter a plea today. prosecutors say oconnell left senator boxer several threatening messages last week. we have developing news right now from near dolores park at san francisco. what you ar are looking at here are police following some

marchers. this all stems after the shooting of a 19-year-old man. >> reporter: after 6:00 people decided to move, chanting anti police slogans. they went to dolore street and made a left turn on 18th and began marching down the street. they were paced by police officers on foot, police officers on motorcycle. i can also tell you that i spoke to nummi's director of operation who was down at the scene. he informed me that he had come here because he heard rumors that there might be troubles at some of the nummi stop, some of the nummi light rail stops and he wanted to come down here and keep an eye on the crowd too and allow the operation people

to know to watch out for protesters crossing from the tracks again. you can see some of the pictures right now from our live view camera as this is happening. of the people marching down i believe 18th street right now angry about that officer involved shooting on sun. at which a 19-year-old parolee was shot as he was pursued by two police officers. police late today said they found gun residue on his hand indicating that he had wielded and fired at least one shot at officers. we've also learned that the police department and members of the mayor's office have tried to lay out the evidence that they have gathered in this case and to tap down some of the tension in this case since it happened on sunday. a community meeting in the bay view will be scheduled for tomorrow at 6:00. but so far these protesters are out on the street. they want to make their opinion known about this shooting and

they're taking to the streets to do it frank and julie. >> david just very quickly. what street are they on again and which way are they marching. >> 18th street, they were headed west on 18th street, they just left dolores park just before 6:00 moving at a steady pace. about 100 people or so in the crowd. again that number grew steadily from a crowd of about 20 at about 5:00 to about 100. many of them wearing black as you can see as well as they march down 18th street. >> all right, keep an eye on this protest that is going on right now on 18th street. keep in mind that could cause problems with the evening commute. specifically for light rail nummi service. we are also hearing that there may be a bus bridge set up at collin. if they are going west on 18th street that would mean that they are headed toward noe street and eventually may make their way up some what in the neighborhood of market street. if they get on market street and they are continuing to march in the street that could

cause some real traffic problems. >> all right, this all as a result of a police officer involved shooting that happened on saturday. where san francisco police shot and killed 19-year-old kenneth harding jr. he was a parolee out of washington street. officers said he fired first. so in return officers fired back. that created tensions in the bay view and as a result these people protesters are upset over that police shooting and they have taken to the streets gathering first this evening in dolores park. now they are headed west on 18th street and obviously effecting traffic in this area of san francisco. so if you're having to be in this area you want to avoid it because protesters here are on the move. we're going to continue to watch them and follow any new developments and bring them to you as soon as we get them. >> we don't know where they plan to eventually get to. but again they are going west on 18th they could end up on castro street or in the vicinity of the church street.

we will keep an eye on this and bring you more information as soon as we get them. the l.a. county board of supervisors voted today to increase their reward to $25,000. that brings the total reward now to $225,000 in the case of stow. stow remains in serious condition after being beaten in a dodger stadium park on opening day in march. a key source of food supplying food banks all over the area has dried up. ktvu's eric rasmussen found out the shortage comes as the demand for food hits an all time high. >> reporter: powe day foes >> reporter: -- potatoes are a source of energy food handed

out. u.s. army vet wilson comes here twice a month. >> the community right here they do need food. people are suffering here in the united states. >> reporter: but a critical program where the u.s. department of agriculture buys up excess food from farmers and gives it to food banks has come to a halt. the alameda county community food bank was getting 80,000 pounds of bonus produce from the usda every month until now. >> that's gone to zero. yeah. >> nothing? >> nothing. >> that's no small amount of food. 80,000 fans is the same weight of a fully loaded semi truck like this one. and the shortages could get even worse. lawmakers in washington are considering millions more in cuts to emergency food programs at a time that calls for help to this hot line has hit an all time high. wilson and the agencies that helped him could end up feeling

the pinch. surviving on a budget of $25,000 a month making ends meet wouldn't be easy. >> what would you do if you didn't have this? >> i don't know, i couldn't tell you. >> reporter: with 30 to 40 people just like him lining up here every day he knows there's only so much food to go around. >> have a nice day. >> thank you. >> reporter: in oakland, eric rasmussen, ktvu news. it is earnings day on wall street and apple is once again reporting record revenue. the tech leader earned more than $7 billion in net profit for the june-quarter. that is $7.70 per share than last year. san francisco based wells fargo also announced record earnings. the bank announced profits of more than $3 billion. that is up 29.5% compared to last year. the numbers top wall street's prediction in part from lower mortgage losses. and news of a possible plan to raise the debt limit along

with those strong corporate profits played well on wall street. the dow jones gained 202 points, the nasdaq closed up 61 points. we learned today the opening of the double slide bypass project on the san mateo might be delayed by more than a year. drilling conditions are constantly changing. they use a type of machine to boor through rock, then they might have to change to a different machinery for a change in material. caltrans hopes to have to have the the project complete by the end of this year but now it looks like the end of next year. under a memorandum signed today in sacramento the rail authority will add affordable housing and connecting transit options with a goal of low

environmental impact. rail backers say federal corporations will bring more -- federal cooperation excuse me will bring more money to the table. >> it's really one plus one equals three so we can work together and we can get more results out of a combined planning effort. so far the rail authority has received about $3.6 billion in federal funds toward the estimated $45 billion cost of that project. leaders in san francisco have upheld the nation's first cell phone radiation law. the san francisco board of supervisors voted unanimously to strengthen the law which calls for warnings about radiation emitted by cell phones and the effects to users help. the city first passed the law last year. it was challenged by the cell phone industry which says the law violated first amendment rights. a former south bay police officer goes to court today in a corruption case involving the hell's angels. hear more about what he's

14 hackers suspected in a string of high profile cyber attacks are under arrest tonight in raids that stretched from the bay area to new york state. sources tell ktvu at least one suspect was arrested in the south bay. an indictment unsealed this afternoon in san jose says the suspects conspired to try to shut down the websites of visa, mastercard and paypal. those companies stopped processing donations to wikileaks. a criminal trial started today in a police corruption case that has rocked the south

bay law enforcement community. new at 6:00, robert handa is live where a veteran santa clara police officer is facing charges that he gave confidential information to the hell's angels. robert-- >> reporter: a jury was selected and a trial is on the way. a case that attracted attention because of the relationship between a former police officer and a member of the hell's angels. the 37-year-old clay rojas faces a dozen criminal counts for providing confidential police information to a member of the hell's angels. >> there was no financial case and the feds case is all about financial gain. the other second very important issue there was no confidential information released. >> reporter: in opening statements, prosecutors told the jury rojas furnished

criminal history and dmv information to william bettencourt. the defendant says rojas and bettencourt were friends. >> when all this took place he wasn't even a hell's angel. >> reporter: the rojas case disappointed the entire department but rojas was detected and arrested. >> this case serves as a deterrent to anyone who when entrusted with information they're going to get caught. >> reporter: and today through jenson, rojas explained. >> none of it went to the hell's angels. it was for a waitress that worked at a restaurant that thought she was being stalked by a fellow. >> reporter: rojas is facing

state charges,bettancourt is being charged separately. there's more evidence that a 19-year-old that was shot by police officers shot at police first. there was gunshot residue on hardings right hand. that provide evidence that harding shot at officers. we want to have live pictures now show you the scene in san francisco. here are the protesters that gathered in dolores park earlier this evening upset over that police shooting involving kenneth harding on saturday. they started in dolores park. then they took their march on the streets and began moving on 18th street west toward the mission. they went through the mission and now they are on market street on the castro. police presence in the area, police are on the edges there

watching these protesters letting them move as they will. but again they are upset about the shooting that happened on saturday in which kenneth harding was shot and killed by police. >> this actually is the intersection now of castro and market. and obviously it is rush hour right now. market street is one of the busiest streets in san francisco and they are blocking at least half of market street. i can't tell if they're blocking the entire street but they are blocking at least half of the streets. so keep that in mind if you are headed home. now it looks like they're crossing market and looks like they're going to march down castro street. from what we understand there are about 100 or so of these protesters. what they are so upset about is that in their opinion they think that the gentleman who was shot and killed did not fire at police and that police had no right shooting and killing him. of course as we mentioned a moment ago, police say that the gunman -- that the person did shoot at them first and that

there was some gun residue on his hand. looks like they're going to this square here, to this corner where a lot of people gather. >> that's the nummi station. >> looks like they are not stopping. they're going down. they're on the move. they've been moving now for some time. they're going down into the nummi station. definitely taking this protest in a particular direction. we're continuing to watch them to see where they go. at this point they're not slowing down, they're not stopping. >> this comes on the heel of that over protest just about a week or so ago at the civic center station where protesters were upset about the person who was shot and killed on the civic center platform. they went down into the civic center. as you may recall caused all kind of problems, delaying trains and stopping b.a.r.t. service through civic center, powell and one other station. now they're going down into

this castro street, nummi light rail station. remember last week b.a.r.t. was saying they were not going to tolerate this any longer. we're going to have to see what happens here. >> there was just some smoke there. we don't know what the smoke is. but they've been chanting, carrying signs clearly visible that they are upset at police. this going on in san francisco at the castro and market into the nummi. >> and more smoke there. >> we don't know what the smoke is. >> it's someone bashing. looks like phones or ticket machines. >> they do, they look like in the distance there, they are clearly upset. and there is a police presence. police are leaving them, watching them and letting them move around. but clearly a very agitated situation. live pictures there, they are on the move and we're going to continue to follow them to see exactly where they're going. looks like some of them are going back into the street. and a little warmer around the bay area today. it'll be warmer the next couple

of days, we'll go to storm tracker 2. there's fog at the coast. that has to do with the northerly wind. keeping the fog from having a big penetration. we're not going to see fog as far inland as we did the last week. these were the highs from today. pretty warm, warmer than yesterday. tomorrow's temperature are going to come up a couple of degrees from these. i think we're going to see temperatures warmer than they have been. that's your wednesday. long range forecast a little warmer, a little drier. a little less fog. early clearing tomorrow because of the way the fog set up. because of that northerly wind. it just tkupt doesn't have that big push. the fog shows it, there's at midnight. it's been full coverage on all nine bay area counties. by 7:00 a.m.

it's just patches of it out there at lands end. looks as though we're going to see less fog. warmer daytime highs, air quality will edge down. it just won't be as good. no major heat wave; just warmer. 54 in vallejo tomorrow. these are your forecast highs then for wednesday. the morning the fog starts to clear away from the coast and we're just by lack of fog going to be warmer. you knew that. high pressure not superstrong but strong enough to get that fog pushed south and to warm us up. forecast highs for seas where you live or near where you live. i have a bunch of them here for you. 44 cities, these forecast highs represent temperatures warmer than they've been in a while. you'll notice it as you go into your wednesday. a warmer day for sure. in your five day forecast, it's a dry one obviously. a warmer one and we start to dip down and temperatures start to cool a little bit as we head toward the weekend again. that helps fire danger. fire danger coming up a little bit in the next few days. thank you, bill.

we have some breaking news right now. two men are now in custody. we have just learning this in the investigation into the death of 21-year-old monica rodust. you may recall her burning body was found in oakland's rock ridge neighborhood. oakland police say they arrested one suspect on a field near steel street. another man was arrested just a short distance away near mills college. investigators are questioning both men. we will have more on this breaking news story coming up tonight on the 10:00 news. >> we want to go back now to san francisco to that developing situation there. here are the protesters on the move. protesters upset about the police officer involved shooting of kenneth harding a 19-year-old man. a parolee out of washington state who is a suspect or person of interest in a fatal shooting in seattle. this young man was shot and killed by san francisco police. and protesters have taken their anger. their demonstration to the
